Acceptance of Terms

By downloading, accessing, or using avoCall, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

Description of the Service

avoCall provides internet-based calling, messaging, voicemail, account, and related communications features. Some features may be available only on certain devices, territories, plans, or app versions. Service quality and availability depend on your network, device, destination, carrier routing, and third-party systems.

Eligibility and Accounts

  • You must be legally able to use the service in your jurisdiction.
  • You must provide accurate account and verification information.
  • You are responsible for activity that occurs through your account.
  • You must maintain the security of your device, login credentials, and one-time passcodes.
  • We may require additional identity or fraud checks for certain accounts, transactions, or calling patterns.

Personal Use and Account Limits

avoCall is intended for legitimate end-user communication. Unless we expressly approve otherwise, you may not use the service to operate a call center, shared communications platform, commercial resale service, or similar high-volume or automated workflow.

  • One person should not create multiple accounts to avoid limits, pricing, fraud review, or bans.
  • You may not resell, rent, transfer, sublicense, or commercially exploit the service.
  • You may not use scripts, bots, auto-dialers, or synthetic traffic against the product.

Contacts, Content, and Permissions

If you import or sync contacts, you represent that you have the rights and permissions needed to provide that data and to use it through the service. You remain responsible for the content you send, store, upload, or transmit, including messages, greetings, support submissions, and other user content.

  • Do not upload unlawful, infringing, abusive, deceptive, or harmful content.
  • Do not use imported contacts for spam, harassment, or unauthorized marketing.
  • We may remove content or limit features where required for legal, security, or operational reasons.

Prohibited Uses

  • Robocalling, auto-dialing, telemarketing, phishing, spam, or call flooding.
  • Fraud, impersonation, social engineering, or attempts to bypass fraud controls.
  • Use that violates law, carrier rules, export restrictions, sanctions, or third-party rights.
  • Reverse engineering, security testing without permission, scraping, or interference with the service.
  • Using the service to generate revenue for third parties without our written approval.

Carrier and Third-Party Dependencies

Parts of the service depend on telecom carriers, routing partners, app stores, payment providers, cloud vendors, and other third parties. Those parties may impose their own rules, technical limitations, pricing changes, or geographic restrictions. We may suspend, restrict, or change features to comply with those requirements.

Payments, Ads, and Promotions

  • Paid features, subscriptions, and credits may be billed through app stores or approved payment providers.
  • Pricing, taxes, and supported destinations may change from time to time.
  • Refunds are handled according to applicable law and the policy of the relevant payment channel.
  • Some experiences may be ad-supported. Premium or paid tiers may remove some ads but not all operational messaging or analytics.
  • Promotional, referral, or bonus credits may be subject to separate terms, limits, destination restrictions, or abuse review.

Monitoring, Fraud Prevention, and Enforcement

To protect users, carriers, and the business, we may use automated and manual review systems to monitor account, payment, device, and usage patterns.

  • We may review call, message, billing, device, and security metadata.
  • We may limit, suspend, hold, or terminate accounts for suspected abuse or policy violations.
  • We may require identity verification or additional documentation before enabling or restoring service.
  • We may cooperate with carriers, payment providers, regulators, and law enforcement where legally required.

Emergency Services

avoCall is not a replacement for ordinary mobile or fixed-line telephone service. Emergency calling, including 911 and similar services, may not be available or may not work correctly. You must have an alternative means of contacting emergency services.

Availability and Changes

We may add, remove, suspend, or modify any feature, destination, rate, supported platform, or integration at any time. We may also update the app or require a newer version in order to continue using the service safely.

Termination

You may stop using the service at any time. We may suspend or terminate your access immediately if we reasonably believe you violated these terms, created legal or financial risk, misused the service, or put users, partners, or the platform at risk.

Termination does not limit obligations that by their nature should survive, including payment obligations, dispute-related obligations, limitations of liability, and compliance cooperation.

Disclaimers

To the maximum extent permitted by law, the service is provided "as is" and "as available." We do not guarantee uninterrupted availability, flawless routing, specific call quality, or compatibility with every destination, device, network, or jurisdiction.

Limitation of Liability

To the maximum extent permitted by law, avoCall will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, missed calls, failed deliveries, service interruptions, or security incidents caused by third parties, carriers, app stores, payment processors, or circumstances beyond our reasonable control.

Governing Law

Unless applicable law requires otherwise, these Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Any dispute, claim, or controversy arising out of or relating to these Terms or the service will be resolved exclusively in the state or federal courts located in Wyoming, and you consent to the jurisdiction and venue of those courts.

Changes to These Terms

We may revise these Terms from time to time. When changes are material, we may provide notice in the app, on the site, by email, or through other reasonable means. Continued use of the service after the effective date means you accept the updated Terms.
